• For the purpose of punishing information-network related criminal activities in accordance with the law, the following opinions on issues concerning the application of criminal procedures in the handling of cases concerning information network-related crime are hereby raised in accordance with the provisions of the Criminal Law of the People's Republic of China, the Criminal Procedure Law of the People's Republic of China, and other relevant laws and judicial interpretations and in light of the investigation, prosecution, and trial practice:
• 为依法惩治信息网络犯罪活动，根据《中华人民共和国刑法》《中华人民共和国刑事诉讼法》以及有关法律、司法解释的规定，结合侦查、起诉、审判实践，现就办理此类案件适用刑事诉讼程序问题提出以下意见。

• I. Scope of Cases Concerning Information Network-Related Crime
• 一、关于信息网络犯罪案件的范围

• 1. "Cases concerning information network-related crime " as mentioned in these Opinions include:
• 1.本意见所称信息网络犯罪案件包括：

• (1) cases concerning crimes of endangering the security of the computer information system;
• （1）危害计算机信息系统安全犯罪案件；

• (2) cases concerning crimes of refusing to perform obligations of information network security management, illegally using the information network, and providing assistance in information network-related criminal activities; and
• （2）拒不履行信息网络安全管理义务、非法利用信息网络、帮助信息网络犯罪活动的犯罪案件；

• (3) other cases concerning crimes of fraud, gambling, and infringement on personal information of citizens in which major activities are committed on the information network.
• （3）主要行为通过信息网络实施的诈骗、赌博、侵犯公民个人信息等其他犯罪案件。
